Use your own judgement
To the maximum extent permitted by applicable law, members use matrimonial profiles, communications, recommendations and compatibility services based upon their own judgement. nri.wedding provides a platform for introduction and information exchange. It cannot control the conduct of every member online or offline.
What we do not warrant
Except for a specific verification expressly stated as having been completed, nri.wedding does not warrant that a member is who he or she claims to be; has no criminal history; has no existing spouse; has accurately stated income or assets; holds the qualifications claimed; holds the immigration status claimed; comes from the family background claimed; has disclosed every relevant medical condition; has the intentions represented; or will behave appropriately after communication or marriage.
Opinions, claims, profile descriptions and messages submitted by members are attributable to those members. Publication of a profile does not mean that nri.wedding independently endorses or certifies every statement in it.
Limitation of liability
Nothing in these Terms excludes or limits liability to the extent that such liability cannot lawfully be excluded or limited. Nothing removes statutory rights that applicable law does not permit a consumer or data subject to waive.
Subject to that, and to the maximum extent permitted by applicable law, nri.wedding shall not be liable for indirect, incidental, special, consequential or exemplary losses arising from use of the Platform, including losses arising from a member’s false representation; fraud committed by another member; private communications; failed matrimonial negotiations; broken engagements; relationship breakdown; marital disputes; financial transactions between users; personal travel arrangements; immigration decisions; employment decisions; reputational consequences caused by another member; or reliance upon information supplied by another user.
Subject to mandatory law, nri.wedding is not responsible for acts or omissions occurring during private meetings or relationships between members merely because the individuals originally discovered each other through the Platform.
nri.wedding shall not be responsible for a matrimonial decision made solely or principally because a member relied upon a compatibility score, Compatibility Engine assessment or automated recommendation. Such tools are supplementary informational aids.
Subject always to rights and liabilities that cannot lawfully be excluded, the aggregate contractual liability of nri.wedding arising directly from a paid Service shall not exceed the amount paid by the affected member for the relevant Service during the twelve months immediately preceding the event giving rise to the claim. This does not apply where applicable law prohibits such a limitation.
You accept the risks of meeting strangers
You acknowledge that meeting, corresponding with, and forming a relationship with a person first encountered online carries risks that no platform can remove, including the risk that the other person is dishonest about who they are, what they own, whether they are married, what they intend, or how they will behave. You accept those risks knowingly and voluntarily, and you accept that nri.wedding is not an insurer against them.
To the maximum extent permitted by applicable law, you release [legal entity name to be set], its owners, directors, founders, officers, employees, contractors and agents from claims, demands, damages and causes of action of every kind arising out of or connected with a dispute between you and another member, whether that dispute arises online, in person, before marriage, during marriage or afterwards. Where applicable law does not permit a general release, this clause applies to the fullest extent that law allows.
No personal liability of founders, officers or staff
The Service is provided by [legal entity name to be set]. Any claim arising out of the Service lies against that entity alone.
To the maximum extent permitted by applicable law, no owner, shareholder, director, founder, officer, employee, contractor, volunteer, moderator or agent of [legal entity name to be set] shall bear personal liability for any claim connected with the Service, and you agree not to bring a claim against any such person in their personal capacity for any matter for which the entity itself would be answerable. This does not apply to liability that cannot lawfully be excluded, such as liability for fraud committed personally by that individual.
Moderation decisions
Deciding what to publish, what to remove, whom to verify, whom to suspend and how to rank profiles requires judgement, and judgement is sometimes wrong. To the maximum extent permitted by applicable law, nri.wedding is not liable for a decision to display or not display a profile, to grant or withhold a verification badge, to remove content, to restrict or terminate an account, or to rank one profile above another, whether that decision was made by a person or by an automated system.
Equally, nri.wedding does not accept liability for failing to detect a fraudulent, married, dishonest or dangerous member. Moderation and verification reduce risk. They do not eliminate it, and no member should treat the presence of a profile on this site as a safety assessment.
Talk to us before you sue
If you believe nri.wedding has caused you loss, you agree to write to us first, setting out what happened and what you want, and to allow sixty days for us to investigate and respond before commencing any formal proceeding. Most complaints are resolved this way, and we would rather fix a problem than argue about it.
This notice period does not apply where a limitation period would expire, or where urgent injunctive relief is genuinely necessary.
Time limit for claims
To the extent permitted by applicable law, any claim arising out of or relating to the Service must be commenced within one year after the cause of action arises. A claim brought after that period is permanently barred. Where applicable law fixes a minimum limitation period that cannot be shortened by agreement, that period applies instead.
Individual claims only
To the extent permitted by applicable law, claims are brought in an individual capacity, and not as a claimant or class member in a purported class, collective, consolidated or representative proceeding. Where applicable law does not permit this restriction, it does not apply to you.
Third parties
These Terms are between you and [legal entity name to be set]. No other person has a right to enforce them, except that the owners, directors, founders, officers, employees and agents of [legal entity name to be set] may enforce the clauses above that are expressed for their benefit.
What survives
The clauses concerning liability, indemnity, release, no personal liability, time limits, intellectual property, confidentiality and governing law survive the closure of your account and the termination of these Terms, however that closure or termination comes about.
Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless [legal entity name to be set], its owners, directors, founders, officers, employees, contractors, agents and authorised representatives from third-party claims, losses and reasonable costs arising directly from your fraud; impersonation; unlawful conduct; infringement of third-party rights; unauthorised uploading of another person’s material; your statements to or about another member; or material violation of these Terms. This indemnity covers reasonable legal costs actually incurred. This does not require a consumer to indemnify nri.wedding for matters where such an indemnity is prohibited by applicable law.
